However if you walk away from your car and the TT is causing the engine to run and subject to the above criteria (213 subsections 3 & 4) YOU are commiting the offence - this still doesn't make your TT illegal just your actions. YOU must stay with your car until the TT turns off the engine. The important distinction to make is its what YOU do and not what the TT does.


And then you get into that lovely gray area of a officer trying to book a unattended vehicle. :whistle: :police:

no grey here only black and white...(although :police: policy says must speak to the driver first in all cases except parking tickets & camera fines!)

:? Wouldn't that legislation mean that Police could affix the unattended vehicle notice to your vehicle. Or are you saying that police policy outside of that legislation dictates that?

Sorry ninja (did not intent to confuse), I quoted you but I was actually trying to get Craig's attention, as he seemed to react as if saying the 3m rule confirmed that TT's are illegal. Anyhow, I think we have confirmed that if you were to challenge a TT defect you would have a very good shot at getting it overturned.

Legislation says they can but their own policy is they don't except for parking tickets without speaking to the driver. Its not to say an individual 'officer' won't do it but his manual says he shouldn't.

You shouldn't get defected for a TT but if do you can't challenge defect notices anyway just as you can't challenge EPA notices. If in addition to a defect (canary) they give you a ticket for driving an unroadworthy vehicle you can challenge that. Make sense? :? Anyway just trying to help you out but you've opened a can of worms.

nup, agree with psyninja, my comment was more to do with the 'legal within 3m' aspect. It's the proximity of the person that keeps it legal or illegal as stated in the cited law.

I emailed the relevant authorities in WA and have received no reply so far. I will post here if they change thier mind and decide to stop being useless.
